Compliance & Monitoring Department(Formerly known as the Labour Relations Department)

The BIBC is a sector and area-specific Bargaining Council created in terms of the LRA. This Act provides that employer and employee representative organizations within an industry or area can enter into Collective Agreements covering “any areas of mutual interest”.

The Agent's powers and functions are given to them in terms of Schedule 10 of the Labour Relations Act as well as Section 26 of the Collective Agreement. The area which they monitor and administer the Collective Agreement extends from Gordon's Bay along the Hottentots Mountains to Malmesbury, as well as the entire Peninsula to Cape Point.

Agents are neutral parties charged with investigating complaints received against Employers, Registering Companies that fall within the Scope of Application of the Collective Agreement, assisting with queries concerning working conditions, Labour Relations Act issues, minimum wage rates of pay, benefits, etc.

Every Agent is allocated a Zone as detailed below. Employers whose registered address fall within that zone is the responsibility of that agent. Our aim is to achieve a stable employment relationship and fair economic competition in the Building Industry. Where the parties are sufficiently representative of the industry, they can approach the Minister of Labour to gazette these agreements and extend them to non-parties as well.

The Compliance and Monitoring Department is responsible for;

  1. The registration of ALL employers in the Building Industry that fall within the Council's area of jurisdiction;

  2. Ensuring that all employers and employees abide by the minimum conditions of employment as spelt out in the Collective Agreement;

  3. The furthering of industrial peace through faciliating a conciliation process between employers and employees;

  4. Receiving and dealing with complaints in respect of conditions of employment as per the Collective Agreement.

  5. Dispensing advise to employers on all labour related matters.
