Compliance criteria

Criteria for determining whether an employer is compliant

  1. Is the employer registered?
  2. Has the employer complied with a request to attend a conciliation meeting, resulting from a complaint received or a routine inspection?
  3. Has the employer complied with a subpoena?
  4. Has the employer complied with an assessment and/or settlement agreement?
    (I.e. has payment, as agreed by the employer, been received)?
  5. Has the employer responded to a request to bring his/her contribution purchases up-to-date?
  6. Has all interest payable on late benefit purchases been paid by the required date?
    (-the Council having satisfied itself that the employer has been duly notified of the interest outstanding).
  7. Has the employer complied with any penalty imposed?
    (i.e. fines imposed as a result of failure to comply)?
  8. Has the employer paid in full any payment order from a Council appointed debt collector?
  9. Has the employer purchased benefits in the last 2 months?
  10. Has the employer complied with an arbitration award in terms of the Collective agreement, where review/rescision has not been sought?
  11. Has the employer ensured that at the time of appointing any sub-contractor, such subcontractor was compliant with the Council’s agreement?
  12. Is the employer in Liquidation?

If the answer to any of the above is NO the employer is deemed to be non-compliant.
